While conflict is an inevitable part of life, disputing parties that cannot come to a resolution can turn to alternative dispute resolution (ADR) methods such as mediation to avoid costly and time-consuming legal battles in court. Working with an experienced mediation lawyer is the best way to help you see beyond the emotions involved to the bigger picture.
At Thomas E. Scifres, P.C., we aim to help you understand what the personal injury mediation process will entail and empower you to make informed decisions about your claim. Tom seeks a more nuanced understanding of the conflicts you’re facing and a fuller examination of potential solutions to better serve you.
Disputes are an inevitable part of most relationships, whether personal or business-related. When the concerned parties cannot resolve their dispute, it might be necessary for them to seek legal assistance.
If the parties to a legal dispute don’t want to go to court, there are several forms of “alternative dispute resolution” (ADR) to avoid that. Mediation is one form of ADR, and it has quickly become the preeminent choice of parties and attorneys since it was adopted in Indiana in the early 1990s. Working with an experienced arbitration and mediation lawyer often helps parties avoid costly and time-consuming legal battles in court.
There are a couple of reasons for the success of ADR. The most important reason is that a majority of the cases that go to mediation settle. Obviously, efficient case resolution is everyone’s goal. But every form of ADR ends in a resolution of some sort. The difference between mediation and all other ways to resolve a case is that mediation leaves the power over the outcome in the hands of the parties. If the parties go to trial, or to some other form of ADR, such as arbitration or a mini trial, they turn the decision over to a third party. A mediator does not have that power over the parties’ case. A mediator simply facilitates collaboration toward a settlement that the parties themselves agree to. In the end, everyone must agree with the outcome before it can settle.
Personal Injury Disputes – Our Specialty
All types of legal disputes are potential candidates for mediation; however, personal injury cases make up the majority of mediated disputes. In injury mediation, the mediator moves between separate rooms to discuss with the defense attorney and the insurance adjuster, and then the victim of the personal injury and their injury claims mediation lawyer.
If you’ve been in injured in an accident, mediation could be an important step toward securing the compensation you deserve for your injuries. A skilled litigation and dispute resolution lawyer can help you understand what the personal injury mediation process will entail and empower you to make informed decisions about your claim.
Insurance mediation attorney Thomas E. Scifres spent his years in Indianapolis representing insurance companies and their policyholders. Upon moving to Salem in 2001, he also began representing injured parties. Having represented both sides, Tom has a unique sense for understanding each side’s approach to evaluating cases. He is familiar with the internal claims evaluation process of insurance companies, yet understands the many difficulties injured parties have in recovering from physical injuries. Tom has even taught collaborative negotiation classes at Indiana Wesleyan University as an adjunct instructor.
In 2007, Tom located his offices in a building he renovated on the southeast side of the Salem Courthouse Square. It has two floors and three conference rooms, allowing him to accommodate multiple parties for mediation in a legal case. All types of disputes are welcome candidates.
